The Judicial Inspection in Spain, a customized training programs

SpainExchange implemented the training program entitled Judicial Inspection that was developed for a delegation of 9 government officials from the High Council of Justice and the Ministry of Justice plus one representative IPLS, an NGO dealing with legal reform. The training event took place from the 6th through the 13th of November of 2005 in the city of Madrid.

The training program was designed by the managing director of SpainExchange and implemented with the assistance of a program facilitator and a technical support persons, two young professionals in the fields of political philosophy and law, who accompanied the participants to all sessions and maintained program focus and continuity.

All the requirements of the Request for Training Proposal were met. The overall objective of the program as stated in the RFTP: “as a result of the training, it is expected that the participants from different institutions will agree on procedures to better work together for effective, impartial inspection of judges,” was accomplished through institutional visits, lectures, and meetings with Spanish professionals in the field. Additionally, a selection of documentation pertaining to the judicial inspection and the Spanish laws applicable to the theme and the objectives of the training program were previously forwarded for translation and review.

The institutional visits included the General Council of the Judiciary, the Supreme Court, the National Audience, the High Court of Justice of Madrid, the Judicial School, and the Judicial Inspectorate. Through theses visits , the program participants learned about the governing body of the courts and those who serve in the administration of justice, the judicial inspection system and its processes . At an additional site visit, the Professional Association of the Magistracy, the participants were able to meet and initiate professional relationships with Spanish magistrates.

Four lectures by professionals in the Judicial Inspections field were imparted at Judicial School. The lectures presented covered aspects related to the judicial inspection function and its applicable regulations; the attention to citizens and handling of complaints and formal accusations; the possible results of the inspection with guidelines and procedures; and an overview of the disciplinary process when a judge's conduct warrants disciplinary action. A participative methodology was used. The participants interacted with the speakers by asking questions and engaging in dialog during the lectures.

Through the activities outlined for the program and the contacts made in Spain, the Albanian delegation returned to their respective entities with clear and practical information regarding inspection of the Spanish courts and judges. Their experience in Spain will assist in improving the effectiveness of the judicial inspection process in Albania.
